Black Patent Malt: The 1817 Malt Tax Workaround Still Used Today

Black Patent Malt exists because of tax law, not flavour experimentation. In 1817, English maltster Daniel Wheeler patented a roasting-drum process that could take ordinary pale malt to a deep black colour quickly and reliably — a direct response to malt tax rules of the period that priced brewers out of using large quantities of the brown and amber malts porter had traditionally relied on. Wheeler's patent (hence "patent malt") let brewers get dark colour and roast character from a small amount of heavily roasted pale malt instead, reshaping how porter and stout were built from that point forward.

Sharp, dry, and used in small amounts for a reason

At 500-600 °Lovibond, Black Patent Malt is one of the darkest common roasted malts, and its flavour matches that intensity: a sharp, dry, almost acrid roast character with little of chocolate malt's smoother coffee-and-mild-chocolate register. Its own starch is effectively carbonised by the roasting process, so it contributes almost nothing in the way of malt sweetness or body — what it brings is colour and a specific dry, roasty bite, full stop.

Why the ceiling sits so low

Black Patent Malt's conventional ceiling, around 3% of the grist, is the lowest of any common roasted malt precisely because its flavour intensity per pound is so high. The SRM colour calculator puts a quarter-pound (0.136 kg) dose against a nine-pound (4.1 kg) pale base in a 5-gallon (19 L) batch already at roughly 17.4 SRM — well into dark-brown-to-black territory from a genuinely small addition.

The overuse mistake

Push Black Patent Malt meaningfully past its conventional ceiling and the beer's roast character shifts from "dry and complex" to "ashy and acrid" fast — this is one of the more unforgiving specialty malts to overdose, since there's very little malt sweetness underneath to buffer the harshness once too much is added. Brewers wanting a bigger, richer roast impression are usually better served adding chocolate malt or roasted barley alongside a small, controlled amount of black patent, rather than increasing the black patent itself.

No diastatic power, and no real fermentables either

Because roasting to this depth effectively carbonises the grain's starch along with denaturing its enzymes, Black Patent Malt contributes essentially nothing to fermentable extract or mash conversion capacity — its entire job is colour and a specific dry roast character, delivered in the smallest dose that gets the job done.

Where it's used

Porter and stout are the classic homes for Black Patent Malt, typically as a small supporting addition alongside chocolate malt or roasted barley rather than the primary source of dark colour — most modern recipes lean on those milder roasted malts for the bulk of their roast character and use Black Patent Malt specifically for the last increment of colour depth and dry sharpness.

Substitution

Black Malt (dehusked) delivers similar colour with noticeably less harshness, since removing the husk before roasting cuts down on the astringent, tannic contribution that comes from roasting husk material directly — a reasonable substitute where Black Patent's specific sharp character isn't essential to the recipe. Carafa III, the German dehusked equivalent, is a further step gentler again and worth considering for a lager where Black Patent's ale-tradition sharpness would read out of place. Neither substitute is a precise flavour match, but both avoid the specific ashy harshness that makes Black Patent Malt unforgiving in inexperienced hands.
